Organization licence agreement

Version 1.0. This is the agreement between your organization and Arlindo Codinha, operating as Zook Design & Marketing, 61 Jasper Ave, York, Ontario M6N 2N1, Canada.
It covers the caseworker tools your staff sign in to use. The public side of getowed stays free for everybody, and our terms of use, privacy policy and accessibility statement apply alongside it.
Who is agreeing
This agreement is between us and the organization named when the account was created.
Whoever creates that account confirms they are allowed to agree on the organization’s behalf.
What you may do with it
Your named staff may use the caseworker tools for as long as this agreement lasts. The licence is for your organization only. You may not transfer it, resell it, or let another organization work under it.
The free public information on getowed is not part of this licence. It stays free to everyone, including you, whether or not you pay us anything.
Plans and seats
A seat is one named person at your organization with their own sign-in. It is not a client and not a case — you may open as many cases as you need.

Keeping the seat count honest
A sign-in belongs to one named person at your organization. Your plan says how many people may have one, and that number is the one thing we ask you to keep honest.
We do not monitor your staff to find out. There is no record anywhere in getowed of who signed in, when, from where, or how much they did, and we have written down — in a decision your procurement officer may ask us to produce — that we will not build one. What we rely on instead is this paragraph and the fact that a shared login makes your own case history useless to you.
If we do come to believe an account is being shared, or that more people are working in getowed than your plan covers, we will write to you and say so. If it continues, we will ask you to move to the plan that fits, at the published price. Only if that is refused do we reduce or suspend access — and never in a way that deletes your casework, which stays yours and stays exportable either way.
How long it lasts
Commons is free and has no end date. A paid plan runs for a year at a time.
On a paid plan you enter a card to start, and nothing is charged for 30 days. We write to you seven days before the first charge. If there is no working card when the 30 days end, the plan is cancelled — we do not charge you and we do not lock you out of your casework.
If you are one of the first 20 organizations to create an account before December 31, 2026, you pay nothing until March 31, 2027, and then 50% of the published price for the year after that. Those terms replace the 30 free days. You do not get both.
Before a plan renews, we write to you at least 30 days ahead. The letter has one link to continue and one link to stop. Stopping is never harder than continuing.
Paying
Prices are in CAD, and we add GST or HST where it applies. You can pay by card, or ask us for an invoice — many organizations pay by purchase order, and that is normal.
We bill for a year at a time. If your team grows mid-year we do not bill you again until the year ends; the size you certify at renewal sets the next year’s plan, and never the one you have already paid for.
If an invoice goes unpaid we write to you, and after 30 days the account becomes read-only. Read-only means you can still read and export everything. We do not delete an organization’s casework for non-payment. Ever.
Stopping and changing plan
You can cancel at any time, from your console. Your access runs to the end of the year you paid for, and then the organization drops to Commons rather than closing.
If a downgrade leaves more people than seats, the owner chooses who keeps write access. Nobody is deleted.
We do not refund the rest of a paid year, with two exceptions: if we change this agreement in a way that matters and you refuse it, or if we shut the service down. In both cases we pay back the part of the year you have not used.
Your casework is yours
The cases your staff create belong to your organization, not to us.
getowed is built with no place for a client’s name, date of birth, address or diagnosis. A case carries the file reference your organization chose, an optional client number that joins one person’s cases, a province, a stage, some dates and an amount. There is no field for anything more, and a check on every build refuses to add one. The list connecting your references and client numbers to a person stays in your own system, where we cannot read it. A few fields are free text, and no design can stop somebody typing a client’s name into one; please do not.
You can export everything from your console at any time, and for 90 days after this agreement ends. After that we delete it if you ask. The history of changes to a case can only be added to. Nobody can edit or delete an entry in it — not your staff, and not us — so a mistake is corrected by a later entry.
Who else touches it
We use five companies to run getowed: Railway to host it, Cloudflare in front of it, HostPapa to run our mailboxes and send our email, Postmark as its backup, and Stripe to take payment. We will tell you 30 days before we add another.
Your casework is stored in the United States, and email you send us is stored in Canada. If your organization is in Quebec and needs a privacy impact assessment before it can use us, write to us and we will answer its questions.
If information you hold with us is ever exposed, we tell you as soon as we can and within 72 hours of confirming it, with whatever we know at the time.
If something goes wrong
We provide getowed as it is. We do not promise it will always be available, and there is no uptime guarantee. We will tell you before planned downtime.
If either of us owes the other money because of this agreement, the most that can be claimed is what you paid us in the 12 months before — or $100 if you are on Commons and have paid nothing. Neither of us is liable for indirect losses.
That limit does not apply to a failure to look after your data, to deliberate wrongdoing, or to fees you owe us.
What we ask of your organization
- One sign-in per person. Do not share logins.
- Do not resell getowed or run another organization’s casework through your account.
- Do not put client names, dates of birth or diagnoses into a case. There is no field for them, and we do not want them.
- Use the export function rather than automated bulk extraction.
Changes to this agreement
We publish a new numbered version and keep the old one. If a change matters, we write to the account owner at least 30 days before it takes effect.
You do not have to accept it. You can end the licence instead, and we pay back the part of the year you have not used. Small corrections take effect when published, with a note saying what changed.
Law and language
This agreement follows the laws of Ontario and of Canada, and disagreements go to the courts of Ontario.
The English and French versions are equally authoritative. If your organization is in Quebec, the French version is the one we present first.
The rest
This agreement, with the pages it links to, is the whole agreement between us about the caseworker tools. If a court strikes out one sentence, the rest still stand.
Neither of us can hand this agreement to somebody else without the other agreeing — except that we may transfer it to a company set up to carry on the same business. We write to each other at the email addresses on the account. The sections “Your casework is yours” and “If something goes wrong” continue to apply after this agreement ends.
